These Terms govern your use of bearmarkheritagenode.com, the BEARMARK HERITAGE platform and app, and any subscription purchased from BEARMARK HERITAGE, LLC ("BEARMARK HERITAGE"). By using the website or service, you agree to them. Effective date: 2026-10-23.

The service and eligibility

BEARMARK HERITAGE is an online tool for building family trees and preserving family history. You can add people as nodes and attach photos, documents, audio recordings and stories, then share them privately with relatives. The service is delivered online. Nothing is shipped.

You must be 18 or older to create a paid account or make a purchase. You are responsible for keeping your login credentials secure.

Your content

You keep ownership of the photos, documents, recordings and stories you upload. You grant us a limited license to store, process and display that content only as needed to provide the service to you and to the people you share it with.

You confirm that you have the right to upload the content and to share information about living relatives. You agree not to upload unlawful, infringing or abusive material. We may remove content or suspend accounts that violate these Terms.

Orders, prices and payment

Prices, including the total amount and any recurring charge, are shown before checkout in the currency displayed at checkout, together with any charges described there.

An order is confirmed when payment is approved. We may cancel orders with pricing errors or suspected fraud and refund any amount paid.

Subscriptions, renewal and cancellation

Subscription plans are charged at the price and billing interval shown on the plan page and at checkout before you buy. They renew automatically at that price and interval until you cancel.

Where required by law, we send a reminder before a renewal charge.

You can cancel at any time from your account area or by contacting our support. Cancellation stops future renewals. Your access continues until the end of the paid period.

Refunds

Refunds are handled under our Refund Policy.

Intellectual property

The website, software, design and our own content belong to BEARMARK HERITAGE or its licensors and may not be copied without permission.

This does not apply to content you upload, which remains yours.

No guarantee of results

BEARMARK HERITAGE helps you organize and share the information you provide. We do not verify the accuracy of genealogical information, and we do not promise specific outcomes. Results depend on the information and materials available to you.

Limitation of liability and governing law

To the extent permitted by law, we are not liable for indirect or consequential damages. Nothing in these Terms limits rights you have under consumer protection laws.

These Terms are governed by the laws of the State of Delaware, United States.
